1) Overview and Scope

This Privacy Policy describes how My Engineering collects, uses, discloses, and safeguards information in connection with our business operations, including:

·        our websites and online services that reference this Privacy Policy;

·        our desktop software products (including Flange Vision);

·        online license validation services and software updates; and

·        our engineering consulting, design, and professional services, including related communications and deliverables.

These offerings are collectively referred to as the "Services." Our Services are intended primarily for business and professional use. We typically collect business contact and technical information; however, some information (including identifiers and business contact details) may be considered "personal information" or "personal data" under applicable law.

In the context of consulting engagements, we often process information on behalf of our clients. Project-specific agreements (such as NDAs, statements of work, or other terms) may include additional confidentiality and data handling obligations. If there is a conflict between this Privacy Policy and a written project agreement, the project agreement will govern for that engagement.

2) Information We Collect

We collect information in three primary ways: (A) information you provide, (B) information collected automatically when you use our Services, and (C) limited information from third parties.

A) Information You Provide

Depending on how you interact with us, you may provide:

·        Business contact information: name, email address, company name (and, if provided, job title/role).

·        Licensing information: license keys and related information needed to provision, validate, or manage your license.

·        Support and communications: information you provide via email or phone, including troubleshooting details and any files you choose to send (e.g., logs).

B) Client Project and Consulting Data

In connection with our engineering consulting, design, and professional services, we may receive or generate project-related information ("Project Data"). Project Data may include:

·        3D scan data, point clouds, and measurement datasets;

·        engineering drawings, models, and CAD/STEP files;

·        specifications, operating conditions (e.g., pressure/temperature), and asset or facility information;

·        photos, field notes, inspection records, and test results;

·        calculations, reports, recommendations, and other deliverables; and

·        business contact details that may appear in project documents (e.g., names/emails of client personnel).

Project Data is primarily business and technical in nature, but may contain personal information (for example, contact details of client personnel).

C) Information We Collect Automatically

When you use our desktop software and related services (including license validation and updates), we may automatically collect:

·        Unique Machine ID: a unique identifier associated with your installation or device used for licensing, activation, validation, and fraud prevention.

·        License validation data: license key and validation status, and technical request metadata when the software contacts our licensing servers.

·        Usage metrics: information about how the software is used (e.g., feature usage frequency), performance metrics, and reliability metrics (e.g., crash or error information).

·        Device and software attributes: operating system and version, application version/build, and similar technical attributes.

·        Network information: IP address and basic connection metadata when our systems communicate with your device (for example, for license checks and update delivery).

We aim to collect business and technical data relevant to operating and improving the Services. Some technical identifiers (like a machine ID, cookie ID, or IP address) may be treated as personal information under certain laws.

D) Information We Obtain From Third Parties (Limited)

We may receive limited information from third parties such as:

·        Business partners/resellers (for example, if a license is purchased on your behalf and user details are provided for provisioning).

·        Subconsultants or other contractors working under appropriate confidentiality obligations, when necessary to deliver services.

·        Service providers (for example, hosting or communications platforms) that help us operate parts of the Services, acting under our instructions.

3) How We Use Information

We use information for the following purposes:

A) Provide and operate the Services

·        provision and manage licenses;

·        enable online license activation/validation;

·        deliver software updates and related communications;

·        perform engineering consulting, design, and professional services, including producing deliverables and communicating with client stakeholders.

B) Customer support and service

·        respond to support requests and troubleshoot issues via email and phone;

·        maintain support records for continuity and quality.

C) Improve and develop products and services

·        analyze usage metrics and diagnostic information to improve performance, reliability, and user experience;

·        conduct quality assurance and improve internal processes, templates, methodologies, and tools;

·        where permitted by contract, create and use aggregated, anonymized, or de-identified information (including de-identified technical datasets such as 3D scan data, models, or similar files) derived from Project Data for internal learning and product development (including improving Flange Vision and other offerings).

When we use information for internal learning or product development, we aim to use information in aggregated, anonymized, or de-identified form and do not attempt to re-identify clients or individuals from such data.

D) Security and fraud prevention

·        protect the integrity of our licensing systems;

·        detect, prevent, and investigate security issues, abuse, or suspected fraud.

E) Business operations and legal compliance

·        maintain business records and internal reporting;

·        comply with applicable laws and regulations;

·        enforce our agreements (including EULAs and license terms) and protect our rights;

·        establish, exercise, or defend legal claims.

4) How We Disclose Information

We may disclose information in the following circumstances:

A) Service providers and infrastructure

We may share information with third-party vendors and service providers who perform services on our behalf and under our instructions (for example, hosting infrastructure for licensing/updates, communications tooling, analytics, and security monitoring). These providers are permitted to use information only as necessary to provide services to us.

B) Subconsultants and contractors

For consulting engagements, we may share Project Data with subconsultants or contractors when necessary to deliver services. Where practical, we do so under confidentiality obligations (such as NDAs) and consistent with client instructions and contractual requirements.

C) Client-directed sharing

We may share Project Data and deliverables with the client and, at the client’s direction, with third parties (for example, a fabricator, installer, or other consultant), subject to applicable agreements.

D) Cloud storage and file transfer

We may use cloud-based tools to store or transfer information (for example, Microsoft OneDrive) when appropriate for collaboration, delivery, backup, or continuity of operations. We use such tools consistent with this Privacy Policy and any applicable contractual obligations.

E) Software vendors for troubleshooting (limited)

In limited cases, and typically only when necessary to diagnose or resolve a software-related issue, we may share relevant excerpts of Project Data or technical context with software vendors used in connection with a project. We do so in a manner intended to minimize the amount of information shared and subject to confidentiality protections where feasible.

F) Business transfers

If we are involved in a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, information may be disclosed as part of that transaction, subject to appropriate confidentiality protections.

G) Legal and safety requirements

We may disclose information if we believe disclosure is necessary to comply with applicable laws, regulations, or lawful requests; respond to legal process; protect our rights, customers, users, personnel, or the public; or investigate and help prevent suspected wrongdoing, fraud, or security incidents.

H) With your direction or consent

We may share information when you direct us to do so or authorize us to do so (for example, if you ask us to coordinate with a reseller, IT administrator, or another service provider you use).

5) Ownership, Confidentiality, and Project Agreements

Project agreements typically govern ownership and confidentiality for consulting engagements. In general:

·        Clients typically own Project Data they provide and the project deliverables we provide to them, except as otherwise specified in a written agreement.

·        My Engineering retains ownership of its pre-existing materials, know-how, methodologies, calculation templates, and the native or working files used to produce deliverables (such as native CAD files), except as otherwise specified in a written agreement.

·        We may retain copies of Project Data and deliverables for recordkeeping, quality assurance, legal compliance, and to support future service needs, subject to contractual obligations.

·        Where permitted by contract, we may create and use de-identified or aggregated insights derived from Project Data for internal learning and product development, including de-identified technical datasets (such as 3D scan data or models).

This section is provided for transparency and does not replace or override any NDA, statement of work, or other written agreement with a client.

6) International Data Transfers

My Engineering is based in Canada. Depending on how our Services are delivered and which service providers we use, information may be processed in Canada and/or the United States. When information is transferred across borders, it may be subject to the laws of the jurisdiction where it is processed.

7) Data Retention

We keep information only as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain support history, comply with legal, tax, accounting, and contractual obligations, resolve disputes, and enforce agreements.

For consulting engagements, retention may also be governed by the applicable project agreement and professional practice requirements. We may retain Project Data, working papers, and related communications for recordkeeping and quality assurance, subject to contractual obligations.

8) Security

We use administrative, technical, and organizational safeguards designed to protect information from unauthorized access, loss, misuse, alteration, or disclosure. However, no system can be guaranteed to be 100% secure.

9) Your Choices and Rights

Depending on your location and applicable law, you may have rights to request access, correction, or deletion of certain information, or to request information about how we use and disclose information. To make a privacy request, contact us at info@myeng.ca. We may need to verify your identity and authority to make the request (including, where applicable, authority to act on behalf of a company).

If we process Project Data on behalf of a client (for example, as part of a consulting engagement), the client may be the primary controller of that data. In such cases, requests may need to be directed to the client, and we will assist as required by applicable law and contractual commitments.

Marketing communications

If we send marketing emails, you can opt out by using an unsubscribe mechanism provided in the message (if available) or by contacting us at info@myeng.ca. Even if you opt out of marketing, we may still send non-marketing communications related to licenses, updates, security notices, or support.

10) Cookies and Similar Technologies

If you visit our websites, we may use cookies and similar technologies for site functionality, security, and to understand website usage.

A) Essential / necessary cookies

Some cookies are used to support core website functionality (for example, security-related features and basic preferences). These are typically required for the website to work properly.

B) Analytics (Google Analytics)

·        Contract: processing is necessary to provide the Services (including licensing, validation, updates, consulting services, and support).

B) Controller / processor roles

For our websites and product licensing/operations, My Engineering typically acts as a controller of the personal data we collect. For consulting engagements, a client may act as the controller of Project Data, and My Engineering may process Project Data as a processor or service provider on the client's behalf, subject to applicable agreements.

C) Your rights

Subject to applicable law, you may have the right to access your personal data, correct inaccurate personal data, request deletion (erasure) in certain circumstances, restrict processing in certain circumstances, object to processing in certain circumstances (including some processing based on legitimate interests), request data portability in certain circumstances, and withdraw consent (where processing is based on consent).

D) International transfers

If we transfer personal data outside the EEA/UK/Switzerland, we will use appropriate safeguards where required (such as contractual protections designed to protect your personal data).

You may have the right to lodge a complaint with your local data protection authority.
